Our relationship with you is our most important asset. We are privileged that you have entrusted us with your financial affairs and committed to safeguarding the privacy of the information we collect. As an SEC-regulated financial institution, BP Wealth Management, LLC (“BPWM”) required to obtain certain personal, nonpublic information about you. The following Privacy Policy demonstrates our commitment to the privacy of your personal information.

How and Why We Obtain Personal Information

BPWM may collect non-public, personal information about you in any of the following ways:

  • New Account Application (i.e., Social Security number, date of birth, income and assets)
  • Transaction activity (types of transactions, balances)
  • Information about your transactions and account experience with us
  • Information from consumer reporting agencies (for example, to verify your identity, to assess your creditworthiness)
  • Information from other outside sources regarding your employment, credit, or other relationship with them
  • Demographic and other general information we obtain that allows us to develop new products and services we can offer you, but that will not be used in any way to determine your eligibility for credit, insurance, employment or products and services that you request.

BPWM limits the collection, use, and retention of your personal information to the extent of assisting us to properly administer our business, service your account and to continue to improve our services to you.

How BPWM Protects the Collection of Your Information

BPWM recognizes the importance of protecting your personal information and we take the responsibility of handling both your trust and personal information extremely seriously.

We do not sell client information to anyone. We also do not disclose any non-public, personal information about you to anyone, whether you are a current or former client, except as permitted by law or as authorized by you. We may share your personal information that we collect “on a strictly limited, confidential basis“ with the following entities:

  • Affiliates, for our everyday business purposes and for our marketing purposes;
  • Unaffiliated third parties, such as the custodian and other entities that need to know that information to assist us in providing services to you;
  • Regulatory agencies such as the SEC along with federal and state law enforcement agencies;
  • Governmental agencies, such as the IRS;
  • Credit reporting and verification resources; or
  • In connection with a subpoena or similar legal process, a fraud investigation, or an audit

BPWM restricts access to your personal and account information to those employees who need to know that information to provide products or services to you or to assist you with ongoing maintenance of your account. We maintain physical, electronic, contractual and procedural safeguards to guard your nonpublic personal information.

BPWM will keep you current on its privacy policy. We will provide you with a copy of our privacy policy annually, as long as you maintain an account with us. We reserve the right to make changes to this policy and in doing so, we will notify you in writing before we make changes that affect the way we collect or share your information.

If you are a former client of BPWM, your information will be treated in the same manner as that of our current clients.

We protect your personal account information by utilizing state-of-the-art security measures whereby all your personal account information is stored on a secure website maintained by the custodian of your assets. Access to view your account online is protected by a unique User ID and Personal Identification Number (PIN).

When you visit our website, a cookie may be transmitted to your computer. A cookie is simply an electronically transmitted file that holds small pieces of information that personalizes and enhances the performance of your experience with BPWM”™s website. Furthermore, it enables us to determine which areas of our website are more popular than others and which of our advertisements on other sites have been visited, which enables us to make improvements to our site. Website Privacy

The 2005 FACT Act requires proper destruction of confidential client information entrusted to Investment Advisers. Banyan utilizes a bonded and insured destruction service which destroys all materials. Materials awaiting destruction between calls are held in a locked bin, and destruction is observed by a Banyan employee.

*BP Wealth Management, LLC, (“BPWM”) is the legal name of a newly-formed entity which is a successor to the business of Banyan Partners, LLC (“Banyan”) a registered investment adviser. BPWM will be a registered investment adviser that has acquired Banyan and certain segments of the wealth and investment management business previously owned and operated by Boston Private Bank & Trust Company (“Boston Private”). BPWM is a wholly-owned subsidiary of Boston Private, which is wholly owned by Boston Private Financial Holdings. (NASDAQ: BPFH)

Documents containing the name Banyan, and Banyan Partners, will be used by BPWM for day-to-day business purposes for at least one calendar quarter (through 12/31/14) and potentially through the first quarter of 2015.

In accordance with the rules under the Investment Advisers Act of 1940, BPWM will rely upon Banyan’s registration under the Investment Advisers Act of 1940 until the registration of BPWM becomes effective. The effectiveness of BPWM”™s registration is anticipated to be within 30 days of filing the Form ADV of BPWM with a filing date on or about October 9, 2014.
